Bounced Pay Roll Check that SHOULD have Cleared....HELP PLEASE?

so im outta ideas here. Back in May our checking account got a retured deposited item and 500 dollars was taken as a result for the bounced check. It was my husbands payroll check that he has previously cashed the week before. Confused I told him to go to his HR and tell her to look into it that if it was something on their end they needed to pay us. Sadly my checks go directly deposited into the accound so the negative activity that was there was quickly fixed due to my check and I needed to pay rent. So after a couple days his HR comes back and says ';here take this money till we figure out whats going on'; and she gave him what his check amout was in cash and he signed a paper.





The bank ours and Lowes bank has given us the complete run around. WAMU said it was Bank of america, bank of america said it was WAMU then WAMU said it was Lowes. We ended up getting copies of the bank statement from B OF A showing that the check DID actually clear 2 days AFTER that money had already been taken out of our account. first someone said oh we cant read the account number on the check thats what caused it to bounce then someone else said that lowes didnt have the funds for it and then lowes said that the funds were there. IVE been saying all along that its an internal error with one of the banks. a month after all this happened...in June my husband gets his new check for working 2 weeks and its for 38 bucks. they had taken OUT the money they gave him saying that the check cleared and he was paid twice. Our bank wasnt doing anything, they wouldnt let me talk to someone higher than them directly at the bank. B of A couldnt do anything and my husband payroll wouldnt return our fone calls. So i contacted WAMUS back office and they looked into it. After more than a month of gathering info, names, talking to people EVERYTHING they could possibly do. they submitted all the info BACK to Lowes and the HR person.


it has now been 7 months and we still dont have our money.





I say someone needs to be sued.....

Who woulda thunk that a Lowes paycheck would bounce?


It's happened to me on more than one sad occasion where my paycheck has bounced 'cause the 'boss' didn't have the cash in the bank, causing all kinds of returned check fees, headache and hassle. Ever since, it's off to the employer's bank, CASH the paycheck and into my account with the cash. And if it was the banks fault as in your case, the same kind of run around. Good luck.


PS: with today's crashing economy, layoffs every day and bad news on top of the last bad news, cashing your paycheck before depositing it may have to become standard procedure for all of us.

I just want to make sure that I am clear.





1. A paycheck bounced and $500 was deducted from your account. (so you are $500 down)





2. Then 2 days later, when the bank auto-redeposits (makes a second attempt) the money cleared and the $500 was put back in your account. (now you are where you should be)





3. Not knowing this, you went to HR who gave you the $500 in cash (now you are $500 better off)





4. The next month the HR deducts the $500 that they paid you in cash as an over payment since your original check did clear on the second attempt. (you are now even)





Is that correct?





If that is the case, aside from potential bounced payment fees, I am not clear where you are out any money. I understand that it has been a hassle, but you aren't out financially.

no, the bank never put back in the money even after we showed them the papers from B of A with the date. we still somehow had already gotten the copy of the check back saying ';return to maker'; if the check was ran twice and ended up clearing the bank never put back the money. when the back office was working on this for me they said they needed a letter FROM that B of A stating the check did clear if they got that then they could process it and give us the refund. never happened.
You can go to your local better business bureau for advice but I think they will tell you to file a complaint with the state bank examiners and they will look into it.





If you go into the bank and try to get it resolved and get stonewalled, sometimes just the threat can get some action.





A few years ago we had 800 dollars go mysteriously missing from our account, my wife dealt with the bank for a couple of weeks, we handed over our check register to the bank administrator and they could find no reason why the money had been taken out or where it was and made no offers to reimburse us. I went down to the bank and didn't get a straight answer either and I just told the lady that if none of us was smart enough to figure it out, maybe the bank examiners could if I reported it to them, the next afternoon our balance was returned.
